RULES OF PARTICIPATION

Your use of the Batting Cages of Batter Up of Gulfcoast, Inc. (“Company”) is strictly conditioned upon and subject to your reading and acceptance of the Rules of Participation below.  Your use of the Batting Cages constitutes your acceptance of these Rules whether or not you sign.

PLEASE READ CAREFULLY!

1         Batters must wear Helmets at all times.
2         Anyone under age 12, or less than 5 ft. tall, must be accompanied by an adult.
3         No one under age 6 may participate.
4         No one under age 16 may use Batting Cage throwing 70 MPH or more.
5         No one may enter a Batting Cage without Helmet, Shirt and Shoes (no cleats).
6         Only one person in a Batting Cage at a time.
7         Keep gates closed at all times.
8         Batting Cages will not operate with wet balls.
9         Batting Cages operate on Tokens only.
10      Swing Bats in Batting Cages only.  No practice swings outside Cage.
11      Do not stand on Home Plate.
12      No Switch Hitting during game.
13      No picking up balls or throwing balls at pitching machine.
14      No one under the influence of drugs or alcohol may participate.
15      No horseplay on premises.
16      No access to mezzanine level of premises.
17      Video Surveillance may be in effect on premises.
18      Any Rule violation will result in termination of game without refund and possible loss of membership.

I acknowledge that I have read, fully understand, and accept the above Rules of Participation.  I understand that participating in use of these facilities can be potentially dangerous and could lead to serious bodily harm.  I assume that risk.  I hereby release, satisfy, forgive, and forever discharge Company and all of its officers, directors, shareholders, owners, employees and personnel, from each and every claim, demand, suit, proceeding, trespass, damage, judgment, right, covenant, promise, agreement, understanding, duty, obligation and liability arising from my use, or any injury from my use, of these facilities.  I assume responsibility for any damage which I cause to Company property arising from my use.
